
Applying for Benefits
Disability Apply helps our clients at every stage of the process of applying for SSD benefits:
THE INITIAL APPLICATION
This is where you submit your application to the Social Security Administration (SSA) along with all of your medical records and supporting documentation. We will help make sure you have everything that’s required. It can take between 90 to 120 days to complete this stage.
RECONSIDERATION
Over 60% of initial claims for SSD benefits are denied. So please don’t worry. You have 60 days to file an appeal with the SSA, and we’ll hold your hand through that. Generally speaking, the appeal process is called a request for reconsideration. It’s basically where your application is sent back to the SSA for a second review. It can take 3 – 5 months for this part of the process to be completed.
HEARING
A hearing is the next step of the appeal process. You’ll have 60 days from a denied reconsideration request to ask the SSA for a hearing. This is where your case will be examined by an administrative law judge. This part can be a waiting game, because the appeal process can take up to two years to complete. On the bright side, over 60% of hearing cases are decided in favor of the applicant.
APPEALS COUNCIL
If you don’t agree with the judge’s decision at the hearing, you can appeal that decision before the Appeals Council. A review by the Appeals Council can take between six months to one year to complete.
FEDERAL DISTRICT COURT
If a claim is also denied by the Appeals Council, you can ask for a review in a Federal District Court. They can either approve or deny a claim for SSD benefits, or they may request another review from the Social Security Administration. It’s estimated that 30% of appeals are won at the Federal District Court level.
