How Long to Wait to Re-Apply for Disability?

While there is the five-month waiting period for first-time applicants, there is no waiting period when pursuing a reinstatement of disability benefits after becoming disabled again.

Oftentimes, applicants do not realize there is a five-month waiting period during the initial application due to the amount of time it takes for the Social Security Administration (SSA) to come to a determination. However, when trying to get back on disability, you do not need to wait through this period again.

Do You Qualify for Expedited Reinstatement?

If you stopped receiving benefits due to increased work or Substantial Gainful Activity (SGA), but your medical condition worsens within five years, then you may qualify for expedited reinstatement.

Expedited reinstatement (EXR) allows you to restart your benefits without beginning the application process all over again. The following outlines when you may be eligible for expedited reinstatement:

– SSI (Supplemental Security Income): If your SSI benefits were terminated due to your income rising above the SSI income limit, then you may qualify for EXR if your income falls below the SSI income limit within five years.

To obtain this, you must apply for EXR within the five-year period. Once the five-year period is reached, you must re-apply to enter the disability benefits system.

– SSDI (Social Security Disability Insurance): If you were able to continue substantial gainful activity after your nine-month trial work period, then the SSA assumes you are no longer disabled and ends your benefits.

However, if your earnings fall below the SGA level within five years, you can have your benefits reinstated by applying for EXR. If you do not re-apply within this five-year period, you must file a brand-new application to receive benefits.

If your EXR request is approved, you may be eligible for up to 12 months of retroactive disability benefits from the date you first filed your EXR application.
